These Terms of Use (“Terms”) govern your use of the Recover & Refuel mobile app and recoverrefuel.com website (the “Services”). By using the Services, you agree to these Terms. If you do not agree, do not use the Services.

1. Purpose and Medical Disclaimer

Recover & Refuel offers general sports preparation, readiness, mindset, sleep, workout and nutrition-related information and tracking tools. Information and calculated scores are for general informational purposes only, not professional medical advice, diagnosis, treatment, or a guarantee of athletic performance. Consult a qualified health professional for health-related questions. Do not disregard or delay professional advice because of information in the Services.

2. Accounts and Appropriate Use

You agree to provide accurate account information, protect your sign-in details, and notify us of suspected unauthorized use. You may not interfere with the Services, attempt unauthorized access, distribute malware, unlawfully collect others’ data, infringe rights, or use the Services for unlawful purposes. You are responsible for the information and messages you submit and for having appropriate permission to share recipient contact details.

3. Minors

The Services are not intended for independent account use by children under 13. Parents or guardians should manage any permitted use on behalf of younger children. Users under the legal age to agree to these Terms should obtain parent or guardian permission. Any age or parental consent requirements within the app also apply.

4. Subscription and Free Trial

Planned launch offer: Eligible new subscribers can receive a 30-day free trial. After the trial, the subscription costs $4.99 per month in the United States, unless canceled before the applicable trial ends. A subscription is expected to renew automatically each month until canceled. The app-store purchase screen will show the final price, applicable taxes, currency, eligibility, and renewal terms before confirmation. Availability and trial eligibility may vary based on Apple or Google account history, location, and the store’s rules.

5. Subscription Management and Cancellation

For subscriptions purchased through Apple’s App Store, manage or cancel through your Apple account’s Subscriptions settings. For subscriptions purchased through Google Play, manage or cancel through Google Play’s Subscriptions section. To avoid a charge after a free trial, cancel before the trial ends. Deleting the app or your Recover & Refuel account does not automatically cancel an app-store subscription. When a paid subscription is canceled, access typically continues through the already-paid billing period, subject to the store’s terms and applicable law.

6. Payments and Refunds

For in-app subscriptions, Apple or Google processes payment, taxes, billing, cancellation processing, and store refund requests under its applicable terms. Refund eligibility depends on the relevant store’s policies and applicable law. Contact the store where you subscribed to request a refund. We do not promise refunds outside the rights provided by applicable law or the relevant store.

7. Features and Availability

We may add, modify, or retire features and content, subject to applicable law and any required notice. Feature availability may vary by platform and subscription status. Internet service, device compatibility, and third-party tools may be required. We do not guarantee uninterrupted or error-free access.

8. Your Content and Sharing

You retain ownership of content you lawfully submit. You grant us a limited permission to host, process, display, and transmit it only as reasonably necessary to operate the features you use. You may not submit unlawful, harassing, deceptive, infringing, or harmful content. If you choose to send inspiration messages or third-party media links, ensure you have appropriate permission to contact the recipient. Third-party GIFs, videos, and other content remain subject to their owners’ rights and the relevant provider’s terms.

9. Intellectual Property and License

We and our licensors retain our rights in the Services, branding, software and provided content. Subject to these Terms and your subscription entitlements, we grant you a limited, personal, nonexclusive, nontransferable license to use the Services for their intended purposes. You may not redistribute or reverse engineer the Services except where the law permits.

10. Third-Party Services

App stores, authentication tools, analytics services, GIF/media providers, and external links may have their own terms and privacy practices. We are not responsible for content or services provided independently by third parties, except as required by applicable law.

12. Disclaimers and Limitation of Liability

To the extent permitted by applicable law, the Services are provided on an “as available” basis without guarantees regarding availability, accuracy, performance outcomes, or fitness for a particular athletic purpose. Nothing in these Terms excludes rights or remedies that cannot legally be excluded, including applicable consumer protection rights. Our liability will be limited only to the extent permitted by applicable law.

13. Termination and Changes

You may stop using the Services at any time; stopping use does not itself cancel an active app-store subscription. We may restrict or terminate accounts for material violations, subject to applicable law. We may update these Terms and will provide notice where legally required. The effective date will appear when published.
